Titre : Comparative contract law : an introduction Type de document : texte imprimé Auteurs : Ermanno Calzolaio, Auteur Editeur : Abingdon, Oxon : Routledge, Taylor & Francis Group Année de publication : 2022 Importance : 204 p Format : 23 cm ISBN/ISSN/EAN : 978-1-03-217053-4 Langues : Anglais (eng) Langues originales : Anglais (eng) Tags : Contrats France Allemagne Italie Angleterre (GB) Index. décimale : 346 Résumé : National legal systems have their own principles and rules on contract law. The trans-nationalization of trade and legal practice involves acting in the context of legal diversity.
This book provides an introductory overview of the main issues of contract law from a comparative perspective, focusing on the legal traditions of civil law and common law.
Featuring short theoretical overviews, followed by cases selected from various jurisdictions, the book shows the concrete application of the principles and rules involved.
Civil law and common law represent two different models of dealing with contract law issues. The book focuses on the French, German, and Italian experiences and on the English legal system, the latter being the main source of inspiration for other common law countries, with some significant exceptions. Topics covered include the structure of contract law and the rules about its formation and interpretation, the role of pre-contractual negotiations, the consequences of mistakes, and breach and supervening events (including the impact of the Covid-19 pandemic). Readers will learn about common problems that are faced when contracting with parties coming from different jurisdictions, whilst also acquiring a deeper understanding of the approach of their own legal system.
This book will be key reading for undergraduate and postgraduate students of comparative contract law, and contract law more generally.Comparative contract law : an introduction [texte imprimé] / Ermanno Calzolaio, Auteur . - Abingdon, Oxon : Routledge, Taylor & Francis Group, 2022 . - 204 p ; 23 cm.

Ethnic accommodation has gained central stage in literature on institutional design and democratic consolidation. However, some divided societies are more explored than others and Afghanistan is one that is critically important for our theories of institutional design in a democratizing, plural society. The work examines the constitution and those provisions of electoral laws and political party laws that together have devised Afghan political institutions including those of the presidential system, unitary government, electoral systems as well as the party system. It argues that due to their incongruence in design and effects, the Afghan political institutions have failed to fully accommodate ethnic groups in the political process. It adopts a holistic approach, while also paying careful attention to the details of each of the individual pieces. Taken together, this approach yields insights about the boundaries and interactions of institutional design. The book will be essential reading for academics, researchers and policy makers interested in constitutional law and politics"-- Constitutional law and the politics of ethnic accommodation : institutional design in Afghanistan [texte imprimé] / Bashir Mobasher (19..-..), Auteur . - Abingdon, Oxon : Routledge, Taylor & Francis Group, 2024 . - 1 vol. Titre : Delivering justice to non-citizens : how criminal courts create borders and boundaries Type de document : texte imprimé Auteurs : Eleonora Di Molfetta, Auteur Editeur : Abingdon, Oxon : Routledge, Taylor & Francis Group Année de publication : 2024 Collection : Routledge studies in criminal justice, borders and citizenship Importance : 1 vol. (XII - 121 p.) Présentation : ouv. ill. en coul Format : 23 cm ISBN/ISSN/EAN : 978-1-03-236842-9 Langues : Anglais (eng) Tags : Criminal justice, Administration of Italy Noncitizens Social conditions Administration Droit pénal Citoyenneté Conditions sociales Italie Index. décimale : 345 Résumé : "How does justice for non-citizens look like' This book provides a nuanced cross-section of how criminal courts deliver justice to non-citizens, investigating rationales and purposes of penal power directed at foreign defendants. It examines how lack of citizenship alters the contours of justice, creating a different system oriented at control and exclusion of non-members. Drawing on ethnographic research in an Italian criminal court, the book details how citizenship and national belonging not only matter, but are matters reproduced, elaborated, and negotiated throughout the judicial process, exploring the implications of this development for the understanding of penal power and the role of criminal courts. Set in the context of the growing intersection between migration control and penal power, Delivering Justice to Non-Citizens explores whether and how instances of border control have seeped into judicial practices. In doing so, it fills a significant gap in the scholarship on border criminology by considering a rather unexplored actor in the field of migration studies: criminal courts. Based on a year of courtroom ethnography in Turin, Delivering Justice to Non-Citizens relies on interviews with courtroom actors, courthouse observations, analysis of court files, together with local media analysis, to provide a vivid image of judicial practices towards foreign defendants in a medium-size criminal court. It considers and balances the distinctive traits of the local context with ongoing global processes and transformations and adds much needed insights into how global processes impact local realities and how the local, in turn, adjusts to global challenges. Through instances of everyday justice, the book calls attention to how migration control has silently seeped into the judicial realm. The book will be of interest to students and academics in sociology, criminology, law, penology, and migration studies. It will also be an important reading for legal practitioners, magistrates, and other law enforcement authorities" Delivering justice to non-citizens : how criminal courts create borders and boundaries [texte imprimé] / Eleonora Di Molfetta, Auteur . - Abingdon, Oxon : Routledge, Taylor & Francis Group, 2024 . - 1 vol. This book presents an overview of the under-examined question of the impact of State practice in Latin America and the Caribbean on the development of the law of maritime delimitation. Examining the status of maritime boundaries in Latin America and the Caribbean this book also ponders the impact of State practice and case law on the law of maritime delimitation. It outlines the historical framework of the establishment of maritime jurisdiction during colonial times and assesses the evolution of maritime delimitation and the contribution of Latin America and the Caribbean to the modern law of the sea. It discusses the law of maritime delimitation and, through jurisprudence, the development of the three-stage methodology to describe and explain maritime delimitation agreements in Latin America and the Caribbean according to the method or methods of delimitation employed. It reviews maritime boundaries in Latin America and the Caribbean that were submitted to third party adjudication as well as provisional arrangements, considering the role of State practice in Latin America and the Caribbean on the development of the law of maritime delimitation. With a renewed focus on Maritime Delimitation, and increasing litigation focused on Latin America and the Caribbean, the book will be of interest to students, academics and practitioners whose field of study is International Law, Law of the Sea, and State Practice" Law of the sea and maritime delimitation : state practice and case law in Latin America and the Caribbean [texte imprimé] / Angel V Horna, Auteur . - Abingdon, Oxon : Routledge, Taylor & Francis Group, 2023 . - 1 vol. As rights have become the preeminent feature of modern political and legal discourse, the work of obligations has been overshadowed. Questioning and correcting this dominant image of our time, this book brings obligations back into view in a way that fits better with the realities of contemporary social life. Following a historical account of the changing place and priorities of obligations in modernity, the book analyses how obligations and practices of obedience are core to understanding how law sustains conditions of inequality. But it also explores the enduring role obligations play in furthering individual and collective well-being, highlighting their significance in practices that prioritize human and environmental needs, common goods, and solidarity. In doing so, it also offers an alternative and cogent assessment of the force, and the potential, of obligations in contemporary societies. This original jurisprudential contribution will appeal to an academic and student readership in law, politics, and the social sciences" Obligations : new trajectories in law [texte imprimé] / Scott Veitch, Auteur . - Abingdon, Oxon : Routledge, Taylor & Francis Group, 2021 . - 1 vol.
