This book explores the current international legal framework and the options available to regulate maritime security in the face of emerging technologies.
MAVs are starting to play a role not only in policing and military security but also for the perpetration of maritime crimes. Through discussing the existing international legal framework for combating maritime security threats, the book will consider the use of MAVs by states for various security purposes and the potential dangers of MAVs in the hands of non-state actors. As the intersection of maritime technology with international maritime security law is crucial to a safe future for all, this timely book makes essential suggestions to adapt existing legal frameworks to match emerging technologies. Addressing critical questions such as who exercises jurisdiction when ships are remotely controlled, how jamming technology may be lawfully deployed and what force may be permissible during maritime law enforcement, this book identifies a diversity of current legal gaps and problems and makes suggestions as to how to rectify them.

This book presents an overview of the under-examined question of the impact of State practice in Latin America and the Caribbean on the development of the law of maritime delimitation. Examining the status of maritime boundaries in Latin America and the Caribbean this book also ponders the impact of State practice and case law on the law of maritime delimitation. It outlines the historical framework of the establishment of maritime jurisdiction during colonial times and assesses the evolution of maritime delimitation and the contribution of Latin America and the Caribbean to the modern law of the sea. It discusses the law of maritime delimitation and, through jurisprudence, the development of the three-stage methodology to describe and explain maritime delimitation agreements in Latin America and the Caribbean according to the method or methods of delimitation employed. It reviews maritime boundaries in Latin America and the Caribbean that were submitted to third party adjudication as well as provisional arrangements, considering the role of State practice in Latin America and the Caribbean on the development of the law of maritime delimitation. With a renewed focus on Maritime Delimitation, and increasing litigation focused on Latin America and the Caribbean, the book will be of interest to students, academics and practitioners whose field of study is International Law, Law of the Sea, and State Practice" Law of the sea and maritime delimitation : state practice and case law in Latin America and the Caribbean [texte imprimé] / Angel V Horna, Auteur . - Abingdon, Oxon : Routledge, Taylor & Francis Group, 2023 . - 1 vol. Titre : Laws of the Sea : Interdisciplinary Currents Type de document : texte imprimé Auteurs : Irus Braverman Editeur : London : Routledge, Taylor & Francis Group Année de publication : 2023 Importance : 302p Présentation : illustrations Format : 24cm ISBN/ISSN/EAN : 978-1-03-207062-9 Langues : Anglais (eng) Tags : Laws of the Sea Interdisciplinary Currents geography anthropology Index. décimale : 341.4 Résumé : Laws of the Sea assembles scholars from law, geography, anthropology, and environmental humanities to consider the possibilities of a critical ocean approach in legal studies.
Unlike the United Nations’ monumental Convention on the Law of the Sea, which imagines one comprehensive constitutional framework for governing the ocean, Laws of the Sea approaches oceanic law in plural and dynamic ways. Critically engaging contemporary concerns about the fate of the ocean, the collection’s twelve chapters range from hydrothermal vents through the continental shelf and marine genetic resources to coastal communities in France, Sweden, Florida, and Indonesia. Documenting the longstanding binary of land and sea, the chapters pose a fundamental challenge to European law’s “terracentrism” and its pervasive influence on juridical modes of knowing and making the world. Together, the chapters ask: is contemporary Eurocentric law—and international law in particular—capable of moving away from its capitalist and colonial legacies, established through myriad oceanic abstractions and classifications, toward more amphibious legalities?
Laws of the Sea will appeal to legal scholars, geographers, anthropologists, cultural and political theorists, as well as scholars in the environmental humanities, political ecology, ocean studies, and animal studies.

Because of the demand by society to find someone to blame for environmental and human loss, there is a constant flow of cases, which serve to confirm the phenomenon but offer no solutions to defend the innocent. The structure of the maritime environment in which they work has changed dramatically, as evidenced by the complex evolution of fleet ownership and management, leaving the Master with diminished management influence. This book has been written in a format which meets the needs of lawyers, academics and maritime professionals, with the aim to analyse the character of criminalisation to determine the features which characterise the phenomenon in Port and Flag State contexts; it interrogates the aim to define the nature of criminalisation and identifies the constituent problems in such criminal accountability. Each chapter relies heavily on case studies to illustrate how the laws which reflect national policy underpinning those priorities are applied in practice. This structure enables an understanding of the problems in the criminal process, with a view to offering options for solutions. The book is directly relevant to a broad range of parties which includes lawyers, academics, P & I clubs, seafarers, shipowners, managers and agents, and national and international seafaring unions Responsibility and accountability in maritime law : criminalisation of the ship's master [texte imprimé] / Simon Daniels, Auteur . - Abingdon (United-Kingdom) : informa law from Routledge, 2022 . - 1 volume (XIII-196 pages) ; 26 cm. - (Maritime and transport law library) .

In light of the protection of increasing number of consumers [xe2][x80][x93] passengers it is almost logical that during the past few decades, international and European transport law has developed almost to revolutionary extent, especially in the field of private aviation (air) law with the introduction of unlimited liability of carriers for death and injury of passengers and commendable sophisticated rights in case of denied boarding, cancellation of flights and long delays. This book will cast light through a critical prism on the most important characteristics of the international transport law, the EU legislation and jurisprudence regarding passenger rights during the carriage by air, sea, rail and road. One of the ideas which, however, needs further research[xe3][x80][x80]is that the commendable legal solutions and experience of the EU can serve as an excellent framework for a new holistic international convention on passengers rights in all transport modes."
